Terms of Service

These Terms of Service (“Terms”) govern access to and use of ThumbnailTools websites, apps, APIs, and related services (the “Service”) operated at thumbnailtools.com.

If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

Draft for product launch. Governing law, entity name, and dispute venue will be completed when the operating company is finalized.

ThumbnailTools helps you evaluate and test YouTube thumbnails and titles (including AI diagnosis, preference testing, automated A/B workflows, research tools, and related utilities). Features may depend on your plan and may change as we improve the product.

Free features may include rate limits, watermarks, or reduced functionality. Paid plans and credits are described on our pricing page and may be updated over time.

• You must provide accurate account information and keep it updated.
• You are responsible for activity under your account and credentials.
• Notify us promptly of unauthorized access at support@thumbnailtools.com.
• We may suspend or terminate accounts that violate these Terms or pose risk to the Service or other users.

You agree not to:

• Use the Service for unlawful, harmful, or deceptive purposes.
• Upload content you do not have rights to use, or that infringes others’ IP, privacy, or publicity rights.
• Attempt to reverse engineer, scrape at abusive scale, or disrupt the Service.
• Circumvent rate limits, credit systems, watermarks, or security controls.
• Use automated testing features in ways that violate YouTube or Google policies, or that risk other creators’ accounts.
• Resell access without our written permission, or use the Service to build a competing dataset by bulk extraction of outputs.

You retain ownership of thumbnails, titles, and other content you upload (“User Content”). You grant us a worldwide, non-exclusive license to host, process, display, and transmit User Content solely to operate and improve the Service (including generating diagnostics and running tests you request).

Optional contribution of anonymized data for model/benchmark improvement is governed by the Privacy Policy (opt-in).

Connecting a YouTube channel is optional and requires OAuth. You authorize us to perform actions you request (e.g. set thumbnails, read allowed analytics) using minimum necessary scopes.

Your use of YouTube remains subject to YouTube’s Terms of Service and Google’s privacy policies. We are not responsible for changes to YouTube APIs, Studio, or policies that limit features.

We take a conservative posture: no automated actions intended to game the platform or endanger your channel.

AI scores, rankings, heatmaps, synthetic panels, and recommendations are estimates and tools, not promises of views, CTR, revenue, or ranking. Real A/B results depend on audience, topic, timing, and factors outside our control.

You remain solely responsible for content you publish and business decisions you make using the Service.

• Paid features may require a subscription and/or credits. Fees are charged via our payment provider.
• Credits are consumable units for compute-heavy actions; unused monthly grant credits may expire as stated at purchase or in-product.
• Taxes may apply. Refunds are handled case-by-case or as required by law / merchant-of-record policy.
• We may change prices with reasonable notice for renewals.

The Service, branding, software, and documentation are owned by ThumbnailTools or its licensors. These Terms do not grant you rights to our trademarks or code beyond using the Service as intended.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THUMBNAILTOOLS AND ITS SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM (OR €50 IF YOU PAID NOTHING).

Some jurisdictions do not allow certain limitations; in those cases, limits apply to the fullest extent allowed.

You will defend and indemnify ThumbnailTools against claims arising from your User Content, your use of the Service, or your violation of these Terms or third-party rights, to the extent permitted by law.

You may stop using the Service at any time. We may suspend or end access if you breach these Terms or if we discontinue the Service. On termination, your right to use the Service ends; provisions that by nature should survive will survive.

We may update these Terms. We will post the new version with an updated date. Material changes may be communicated in-product or by email when appropriate. Continued use after the effective date constitutes acceptance where allowed by law.
